Sub: Show Cause Notice under clause 45(b) of Bihar Cricket Association (BCA) for attending an unauthorized/illegal SGM on 12/02/2023 at Siwan


Dear Sir,

With regard to the above captioned subject, kindly note the following:
· A requisition SGM of Bihar Cricket Association (BCA) as per rule 12 (1) (c) of BCA Rules & Regulations had already been convened on 04/02/2023, in which the General Body of BCA had unanimously stopped Mr. Rakesh Kumar Tiwary to work/function as the President of BCA.

· On 08/02/2023, the Honorary Secretary of BCA had duly informed all the members and stakeholders of BCA via email(s) and also issued a notice on website about the illegal/unauthorized SGM called by Mr. Rakesh Kumar Tiwary on 12/02/2023 at Siwan, wherein the Secretary had clearly mentioned about the illegality of the so called SGM at Siwan, and had specifically requested/instructed the members of BCA from refraining to attend any such meeting.

· The so called SGM as notified by Mr. Rakesh Kumar Tiwary was in violation of the BCA Rule 12 (1) (a), (b) & (c) of BCA Rules & Regulations. In view of the above mentioned facts, it has been found that you/your district cricket association had participated and attended the so-called unauthorized SGM called by Mr. Rakesh Kumar Tiwary at Siwan on 12/02/2023, which amounts to gross misconduct. Therefore as per the Rules & Regulations of BCA, a Show Cause Notice is hereby issued to your district association under clause 45(b) for such act, behavior or conduct that has brought disrepute to Bihar Cricket Association and has been considered prejudicial and undesirable to the interest of BCA (Rule 48 (a)); leading to the grounds as mentioned in clause 5 (a) iv, v, vi, vii of BCA Rules & Regulations for termination of membership. You are requested to send in your reply within 48 hours of the date of issue of this show cause notice, in respect of your act, behavior and conduct as mentioned above, clarifying as to why the membership of your DCA shall not be terminated by the BCA and further appropriate actions be taken.

Any other players and other officials of your district who were also a part of this unauthorized meeting, once identified, will also be subject to appropriate actions as specified under Rules and Regulations of BCA.
